Terms and Conditions
These Terms and Conditions define the rules governing the use of the Szlaki service, owned and operated by W3media.pl s.c., headquartered at al. Powstania Warszawskiego 15, Kraków, Poland.
§1 Definitions
- Operator – W3media.pl s.c., headquartered at al. Powstania Warszawskiego 15, Kraków, Poland, VAT ID: 945-212-37-28, e-mail: kontakt@w3media.pl
- Application – the Szlaki mobile applications for Android and iOS
- Website – the website available at szlaki.app
- Service – the Application, the Website, and the server-side software required to provide the services
- User – a natural person using the Service in any way
- Account – an entry in the Service database confirming the User's registration, including registration via Facebook, Apple, or Google
- Maps – map layers, hiking trail information, and points of interest made available through the Service
- User Content – content shared by the User within the Service, including photos, comments, and recorded route tracks
- Content – all content available through the Service, including Maps and User Content
- User Profile – a section of the Application and Website containing publicly available information about the User, including the User's name, profile photo, and User Content
§2 General Terms
- The Operator provides electronic services to the User through the Service as described in these Terms and Conditions.
- The Operator does not guarantee that the Service will function correctly, in whole or in part, and shall not be liable for any damages resulting from errors, failures, or interruptions in the operation of the Service, including the loss of User Content.
- The Operator shall not be liable for any consequences resulting from route planning or navigation instructions provided by the Service. The Operator makes every effort to ensure that the Content is accurate and up to date and that the generated navigation instructions are as accurate as possible.
- The Operator reserves the right to temporarily suspend the availability of the Service, particularly due to failures, maintenance, or upgrade work.
- The Operator is not responsible for Content created by third parties, including User Content.
- The Operator is not responsible for the factual accuracy of the Content.
- Advertisements may be displayed within the Application and the Website. The Operator is not responsible for the content of advertisements or for the content of websites linked from those advertisements.
- Use of the Service is voluntary and free of charge for all Users.
- The Operator may introduce paid services. The User will always be informed whenever a fee is required. The User shall never be obliged to pay for a service unless they have agreed to receive it as a paid service.
§3 Account
- The Application allows Users to create an Account through the registration form or by signing in with Facebook, Apple, or Google.
- When registering an Account, the User provides their e-mail address and agrees to receive technical information regarding the operation of the Service, information about new features, and marketing communications from the Operator.
- The User's e-mail address is never publicly displayed within the Service. It is used solely for the purposes specified in these Terms and Conditions.
- The User must not use another person's personal data, including another person's e-mail address, during registration.
- After registering using an e-mail address, the User will receive an activation e-mail containing a link to activate their Account.
- The User is responsible for keeping their password confidential. Any actions performed using the correct password shall be deemed to have been performed by the User.
- The User may delete their Account together with all associated personal data at any time using the function available after logging into the Application.
- In exceptional circumstances, the Operator reserves the right to delete a User's Account and User Content without prior notice and without providing a reason.
§4 Personal Data
- The Operator is the controller of the User's personal data.
- Personal data is collected directly from Users registering for the Service.
- During registration, the User must provide an e-mail address, full name, gender, and weight. This information is necessary to provide the Service.
- The User's e-mail address is never publicly displayed within the Service.
- The purposes of processing personal data are:
- creating an Account in the Service;
- providing electronic services through the Service;
- analyzing and managing User activity in order to personalize services and content according to individual preferences;
- conducting marketing activities.
- Under the GDPR, Users may have the following rights regarding the processing of their personal data:
- the right of access to personal data;
- the right to rectify personal data;
- the right to erase personal data;
- the right to restrict the processing of personal data;
- the right to object to the processing of personal data;
- the right to data portability;
- the right to lodge a complaint with a supervisory authority;
- the right to withdraw consent to the processing of personal data.
- The Operator does not sell or share Users' personal data with other individuals, companies, or institutions without the User's consent.
- Users' personal data may be disclosed to entities authorized to receive such data under applicable law, including competent judicial authorities.
§5 Content
- The User bears full and unlimited legal responsibility for all User Content.
- The User may upload only User Content that they have created and for which they hold full copyright and related property rights.
- The User grants the Operator a free, unconditional, and royalty-free license to publicly display the User Profile and User Content within the Application and on the Website.
- Uploading photos containing the likeness of other persons requires the User to obtain all legally required permissions. The User bears full responsibility for any infringement of the personal rights of third parties.
- If any third-party claims arise as a result of the publication of User Content, the User shall reimburse the Operator for all reasonable costs incurred in connection with such claims.
- Users are prohibited from publishing advertisements or other commercial content.
- The Operator reserves the right to remove any Content without providing a reason.
- Location data recorded by the Application may be used anonymously for statistical analysis of completed routes and to verify the course of hiking trails used by the Service.
§6 Final Provisions
- These Terms and Conditions become effective on the date of their publication.
- The Operator reserves the right to amend these Terms and Conditions. Registered Users will be notified of any changes electronically.
- By using the Service in any way, the User declares that they have read these Terms and Conditions and agree to be bound by them.
